The cornerstone of the EU’s strategy lies in the recently enacted AI Act, which sets out to regulate artificial intelligence systems, including the contentious realm of deepfakes. 

Unlike blanket bans, the Act adopts a nuanced approach, categorizing deepfakes as “limited risk” AI systems, subjecting them to fewer regulations compared to high-risk counterparts like medical AI or facial recognition. 

However, the Act’s classification has drawn scrutiny, with advocates arguing for heightened scrutiny and classification of deepfakes as high-risk due to their potential for significant harm.

Under the AI Act’s provisions, transparency emerges as a key principle. Article 52(3) mandates creators of deepfakes to disclose their artificial origin and provide details about the techniques employed. 

By empowering consumers with knowledge about the content they encounter, the EU seeks to mitigate susceptibility to manipulation and disinformation. Nevertheless, concerns persist regarding the effectiveness of disclosure requirements in deterring malicious uses, particularly if creators devise means to circumvent them.

The role of the EU AI office: Promoting responsible AI practices

To bolster its regulatory framework and ensure effective implementation, the EU has established the AI Office, signaling a pivotal step towards fostering responsible AI practices within the Union.

Criminalization of Deepfakes: A controversial approach

Amid calls for stringent measures to curb deepfake proliferation, advocates argue for the criminalization of deepfakes for end users, citing the need for accountability and deterrence against malicious intent. 

Proponents contend that criminal penalties would serve as a deterrent against fraudulent activities, political manipulation, and dissemination of harmful content. However, the prospect of criminalization raises complex considerations, including the delicate balance between safeguarding free speech, privacy rights, and technological innovation.

While criminalization offers a potential solution, policymakers face the challenge of devising effective enforcement mechanisms and fostering international cooperation to address the transnational nature of deepfake-related threats. 

Moreover, the EU must navigate the intricate terrain of digital literacy and critical thinking, equipping the public with the tools to discern truth from manipulation effectively.
